Rewards Program Terms and Conditions

The ‘Woohoo Crew’ Rewards Program (also referred to as Woohoo Body's Rewards Program, previously Happy Skincare’s Rewards Program and previously 'Love Happy' Rewards Program) is a customer rewards program (“Program”) managed and conducted by The Happy You Company (ABN 21628801267) ("Woohoo Body", “Happy Skincare”, “we”, "us" or “our”) for the benefit of its customers (“Customer” or “you”). Opting in to the Program is automatic upon: the creation of an activated customer account (“customer file”) which includes your personal information by either:

  1. Registering online at https://www.woohoobody.com.au/account/register, or by
  2. Registering in person at our physical store
  3. Choosing the option to join the create an account during checkout when making a purchase.

By opting in to the Program you agree to the Terms and Conditions set out here and in our Privacy Policy, Cookie Policy, and Website Terms of Use. Please read these Terms and Conditions and policies carefully before you use and/or opt in to the Program.

PARTICIPATION AND MEMBERSHIP

Participation in the Program is only open to all Woohoo Body customers that have access to woohoobody.com.au or our physical store at 12/75 Bailey St, Adamstown NSW 2289 (our "stores"). If you are under the age of 18 years, you must have parental/guardian approval to opt in to the Program, and further your parent/guardian must read and consent to these Terms and Conditions. These Terms and Conditions will be accepted by you and will be binding on you at the time of opting in. If you do not agree to be bound by these Terms and Conditions please do not participate in the Program.

REWARDS PROGRAM LEVELS:

As part of the Program, you will unlock levels by purchasing goods in our stores, and/or performing certain ‘point-earning’ behaviours:

  • Level 1 - Crewmate - This is the entry level and requires no minimum spend
  • Level 2 - Best Mate - This level is reached when you have spent over $350 in the past 365 days since the rewards program was launched on 1 November 2018.
  • Level 3 - Soul Mate - This level is reached when you have spent over $800 in the past 365 days since the rewards program was launched on 1 November 2018.

Any transactions that occur in one of our partner retail stores will not count to the Program. Orders placed online can take up to 36 hours to reflect in a customer’s Rewards Dashboard.

To the extent that a Reward Level has been achieved by you in connection with a breach of these Terms and Conditions or otherwise incorrectly allocated to you, including as a result of an error on our part, we may adjust your Reward level to the extent necessary to address the breach or error (as the context permits).When a Customer obtains a refund or reimbursement for goods purchased from our stores, an adjustment is also made to the rewards account in the amount of the reimbursement granted.

CALCULATION OF REWARD POINTS

Purchases in our stores will be converted into points provided you use the email address associated with your Rewards Program account. The program excludes returns, refunds, delivery charges, and the purchase of gift cards. Rewards spend includes local taxes.

Your spend will be calculated and accumulated over a rolling 12 month period and your point balance is accessible in real time. We reserve the right to change points balances if it believes someone is unfairly accumulating points not within the rules set out in this document. Program Spend will not be calculated more than once.

Points earned as part of this loyalty program are not redeemable as cash or monetary value.

  • Level 1 - Crewmate - 1 Point will be accrued for every $1 spent
  • Level 2 - Best Mate - 2 Points will be accrued for every $1 spent
  • Level 3 - Soul Mate - 3 Points will be accrued for every $1 spent

WRITING A REVIEW

50 Points will be accrued for each product review written on woohoobody.com.au. There is a limit of 3 reviews per week and 12 reviews per year. The review must be for a product you have purchased from our website, www.woohoobody.com.au with a matching email address. You may earn points for reviews only once for each product (full sized products and samples are regarded as being the same product).

CELEBRATING A BIRTHDAY

200-400 Points (depending on level) will be accrued when you celebrate your birthday. Your birthday must be submitted to the Rewards Program ‘Earn Rewards’ page at least 30 days before your birthday takes place.

REFERRALS/SHARE WITH A FRIEND

200 Points will be accrued when you refer a friend. See the next section for terms and conditions relating to referrals.

SOCIAL MEDIA

20 Points will be accrued when you like Woohoo Body's Facebook page, follow Woohoo Body on Instagram, and share the Woohoo Body facebook page. These actions must be performed from the Rewards Program ‘Earn Rewards’ page.

REFERRALS

These terms and conditions apply to the referral (or "Share with a friend") component of the Rewards Program. By referring a friend, the referring customer agrees to be bound by these terms and conditions.

A Referral is defined as a purchase made by a customer (the ‘referred customer’) through exclusively using another customer’s (the ‘referring customer’) unique referral discount code. If a referred customer does not use/redeem this unique discount code to make a purchase, this purchase will not count as a Referral. A minimum purchase amount of $25 (excluding shipping) applies to these discount codes.

For the first purchase made by a referred customer because of a referral, the referring customer will accrue points as part of the program. Referrals are subject to verification. They must be a new customer to Woohoo Body, and not have an existing customer account at our stores. The referred customer must not be the same person as the referring customer. We may withhold the offer for a referral where it deems a customer has referred a customer under fraudulent or suspicious circumstances and/or are in violation of these Terms and conditions.

TRANSFERS AND CUSTOMER FILES

Any transactions by another customer in our stores cannot be transferred to a different customer for someone else to obtain Points.

There can be only one customer for each Rewards Program membership. Transactions from multiple Customer files cannot be joined into one spend amount. It is your responsibility to ensure that we have only one Customer file for you. If you suspect that you have more than one Customer file, please contact our customer support team.

Any Points cannot be sold, transferred, assigned or otherwise dealt with except in accordance with these Terms and Conditions. Points have no cash or monetary value and cannot be taken or redeemed as cash or equivalent

REDEEMING REWARDS

Rewards are redeemed by “spending” points. Various rewards can be redeemed for different points values and these will change from time to time.

Any rewards, gifts, benefits or offers communicated as part of the Program may include specific offer terms and conditions, including expiry dates and redemption conditions. You should read these Terms and Conditions carefully. Only Rewards Program members who receive our email communications are eligible to use and redeem any rewards, gifts, benefits or offers. All offers, gifts, benefits or rewards are not transferable and cannot be redeemed for cash or equivalent.

All reward gifts, benefits or offers are subject to availability. We are not liable for any rewards, gifts, benefits or offers not being available for any reason.

If you have opted-out of receiving our email communications you will not eligible to receive any rewards or perks of the program.

We reserve the right to change or withdraw the rewards and giveaways and these terms at any time without notice.

FREE PRODUCTS

You can spend your points on various free products (e.g. You Crack Me Up Lip Balm, Warm Fuzzies Firming Body Cream, Blissed Out Body Oil, or Happily Ever After Eye Serum). These discounts can not be applied to subscriptions/automatic deliveries through our website due to technical limitations but our team can arrange for these free products to be added to your subscription. Please contact us if you would like to do this. There is a limit of 1 of each free product per order, but you may include multiple different free products in your order. You must include at least 1 other product in your order that is not free.

ADDITIONAL REWARDS/PERKS

The following additional rewards and program perks may be made available from time to time.

DOUBLE POINTS

Double points are only awarded to customers who are a part of the Rewards Program and who purchase products through our stores during the promotion hours stated.

FLASH SALES

Flash sales are only available to customers who are part of the Rewards Program and who have reached Level 2 or above. During these promotion periods, customers will be supplied with 1x unique discount code (discount amount will be defined at the time of the promotion), valid for their next purchase. Limit of 1 unique discount code per customer, valid for only 1x order. The discount code can only be used during the times stipulated by the terms and conditions of the flash sales at the time and cannot be used with any other offer.

COMPETITIONS

Each major prize pool will have its own set of terms and conditions.

SHARING SELFIES

We will offer varying points when you email a qualifying "selfie" (photo of yourself with your favourite Woohoo Body product). These must be emailed to crew@woohoobody.com.au. We reserve the right to decline inappropriate submissions. By sending us this photo you consent to its use on our website and social media accounts.

SHARING BEFORE AND AFTER PHOTOS

We will offer varying points when you email qualifying "Before and After" photos to us. These photos should show a photo showing your skin's condition BEFORE you started using our products, and again at least 2 weeks (but ideally 30 days) AFTER using the products. The photos should show an improvement in the appearance of your skin. These must be emailed to crew@woohoobody.com.au. We reserve the right to decline inappropriate submissions. By sending us these photos you consent to its use on our website and social media accounts.

MEMBERSHIP OF FACEBOOK GROUPS

Customers who are in Levels 2 and 3 will be invited to join our private facebook group where there are opportunities to meet other members of our community, win prizes, join the product development program (below), and otherwise engage with our team. 

PRODUCT DEVELOPMENT (TESTING) PROGRAM

Only customers who are in Levels 1, 2 or 3 who have joined our private facebook group will be eligible for this program. Customers are not guaranteed to receive any free products or free testers at anytime in regards to this perk. Customers in the product development program will be asked to volunteer via our facebook group and will be selected at random at a date that is nominated in the post asking for volunteers. Customers must have a valid email address listed in their Rewards Program account in order to take part. Customers will be requested to complete a survey within a few weeks of receiving products. We reserve the right to select the product sent to customers and the customers who receive these products. We reserve the right to halt this program at any time.

We will not post or announce the personal details of the recipient, subject to the terms of our Privacy Policy. Refer to our Privacy Policy regarding use of your personal information.

REWARD POINT EXPIRATION

It's our hope that you redeem your Reward Points on a regular basis. All unredeemed Reward Points will expire when a program member has not engaged in any activity to earn Reward Points (through purchase or other activities) for 12 months or more. If you have questions regarding the date of your last activity or your last purchase, check your Woohoo Crew Rewards Program page. If you feel your Reward Points have been expired in error, please contact us for assistance.

In addition, Reward Points will automatically expire if your Membership is revoked or otherwise cancelled for the reasons further detailed in the 'Suspension and/or Termination' Section.

CHANGE OF DETAILS

You should advise us of any change of name or email address by via email at crew@woohoobody.com.au. We are not responsible for any failure by you to notify us of your change of details, which may result in you not obtaining the benefit of our communications and rewards, gifts or benefits or the loss or downgrade of a Rewards Program level. Changes to your details other than name and email can be made via your My Account page at https://www.woohoobody.com.au/account .

SUSPENSION AND/OR TERMINATION

We may immediately suspend or terminate your participation in the Rewards Program without further notice if you: (a) have breached these Terms and Conditions; (b) have engaged, or may engage, in fraudulent conduct, or conduct that is suspected to be fraudulent, in relation to our company, the Rewards Program or your Customer file; (c) have engaged in inappropriate conduct that undermines the reputation or legitimate interests of Woohoo Body; (d) have supplied or are attempting to supply false or misleading information to us; (e) are selling, assigning, transferring, acquiring, or offering to sell, assign, transfer or acquire any Woohoo Body awards, gifts, offers or benefits other than in accordance with these Terms and Conditions; (f) act in a hostile, abusive or aggressive manner towards any of our staff or any other Customers online; or (g) become bankrupt.

Where your right to participate in the Rewards Program is suspended or terminated, any benefits, rewards, points, rights and status you may have at that time under the Rewards Program shall thereby suspend or terminate (as the case may be).

The Customer’s participation in the Rewards Program may be terminated by either Woohoo Body or the Customer by providing the other party with at least 30 days written notice.

WARRANTIES AND LIABILITY

All conditions, warranties, guarantees, rights, remedies, liabilities or other terms that may be implied or imposed by custom, under the general law or by statute, whether express or implied, as to the condition, suitability, quality, fitness or safety of any goods or services supplied under, or pursuant to, the Rewards Program (“Warranties”), are expressly excluded to the extent permitted by law.

Nothing contained in these Terms and Conditions excludes, restricts or modifies the application of any condition, warranty or other obligation, the exercise of any right or remedy, or the imposition of any liability under the Competition and Consumer Act 2010 (Cth) or any other national, State or Territory legislation (the “Acts”) where to do so is unlawful. To the full extent permitted by law, where the benefit of any such condition, warranty or other obligation is conferred upon the Customer pursuant to any of the Acts, our sole liability for breach of any such condition, warranty or other obligation is limited to:

  1. in the case of goods, supplying the goods or services again or payment of the cost of having the goods or services supplied again;
  2. in the case of any claim relating to points, to crediting that number of points to the Customer’s account; or
  3. in the case of any claim relating to a reward, to crediting the number of points redeemable for that reward to your Rewards Program account.

To the extent permitted by law, we will not be liable to the Customer (or any person claiming under or through the Customer) or any third party for:

  1. any personal injury or death to the Customer or any third person;
  2. indirect, consequential, incidental, special or exemplary damages, expenses, losses or liabilities;
  3. the loss, theft or destruction of a reward, gift, offer or benefit; or
  4. any delay in replacing a reward, gift or benefit or unauthorised use of any product, gift, benefit or reward, arising out of, relating to or connected to the provision or use of the Rewards Program, any reward, gift, offer or benefit or any goods or services supplied by Woohoo Body.

We shall not be liable to the Customer or third party for any delay or non-performance of its obligations under these Terms and Conditions arising from any cause beyond its control including, without limitation, act of God, governmental act, war, fire, flood, explosion or civil commotion, malicious damage, compliance with any law or governmental order, rule, regulation or direction, accident, breakdown of plant or machinery, fire, flood, storm or default by or act or omission of a third party provider, hosting or data centre providers or other suppliers or sub-contractors.

GENERAL INFORMATION

Woohoo Body expressly reserves the right to change the Rewards Program elements (including, but not limited to, the levels, expiry dates or the way in which rewards, gifts, benefits or offers are earned and redeemed) or cease running the program at any time (without any liability to the Customer or any third party). We will use reasonable endeavours to give advance notice to all Customers of any material changes in writing or by otherwise posting it on our website or other channels. If you do not agree to these changes, you may terminate your participation in the Rewards Program by providing Woohoo Body with at least 30 days’ written notice after the date you received written notice of the changes or the changes were posted on our website or other social media channels.

A notice or communication shall be deemed to be given by Woohoo Body to you if it is sent to your email address listed in your Customer file or by otherwise posting it on our website or other social media channels.

You are solely responsible for any government tax, duty or other charge imposed by law in any country in respect of the Rewards Program, your participation in the Rewards Program, rewards offered or any other transaction within, or arising out of, the Rewards Program.

If any provision (or part of a provision) of these Terms and Conditions are found by any court or administrative body of competent jurisdiction to be invalid, unenforceable or illegal, the other provisions shall remain in force. If any invalid, unenforceable or illegal provision would be valid, enforceable or legal if some part of it were deleted, the provision shall apply with whatever modification is necessary to give effect to the commercial intention of the parties.

GOVERNING LAW

These Terms and Conditions, and your participation in the Rewards Program, is governed by and will be construed in accordance with the laws of the State of New South Wales, Australia irrespective of where the application for your Customer file has been completed. In any action or other legal process with respect to any matter or thing in connection with these Terms and Conditions, and your participation in the Rewards Program, you submit to the non-exclusive jurisdiction of the Courts in the State of New South Wales.
